Shaykh Shadee Elmasry translates Shaykh Ahmad Al-Maghilis response.

There is an opinion among some Hanafis that you can take and give riba / interest in Dar al-Harb. It’s a fiqh opinion usually brought out when someone wants to justify getting a mortgage. Shaykh Shadee Elmasry asked Shaykh Ahmad Al-Maghili if the Malikis have a similar opinion:

“First of all a person cannot live in Dar al-Harb let alone take riba / interest and increase his wealth and do other forbidden things. We can’t support this and the only time riba / interest is allowed for a muslim is when he is completely starving and he fears he is going to die. Not only is riba allowed then but other haram things also. So we can’t support this Hanafi opinion , we don’t believe it is correct.”
